How to trademark or copyright a business name?

As previously mentioned, you can search existing trademarks and register your mark on the PTO website. But, note that a mark can also have common law protection at the state level even if it isn't registered with the PTO, so you should use available means (phone books, search engines, directories) to determine if someone is already using that mark.
